IS CONTRACEPTION ALLOWED IN CERTAIN CASES? By: Bro. Ramon Gitamondoc

Development from Jimmy Akin: Church’s teaching on contraception is only within marriage.
This
development occurred after discussions have been made concerning Pope
Benedict XVI’ statement on condoms. I am posting this, not because I
consider Akin an authority on this matter, but because Filipino
apologists respected him. I also believe that he had read some of my
blog posts regarding the Pope’s statements.
MY COMMENTS:
Three
points I want to share here. Firstly, the use of the sexual faculty
outside of marriage [premarital and extra-marital] has always been
condemned by the Church as immoral. Secondly, the use of contraception
is considered by the Church as intrinsically evil and therefore whether
is it practiced within or outside the marriage state it is still
immoral. Thirdly, there is no statement by Pope Benedict XVI wherein he
allows the use of condom in any circumstances whatsoever. Some people
wanted to think so but this is nothing but a misapprehension of what the
Pope wrote.

Point
1 is correct. Point 2 needs to be qualified. The meaning of “Intrinsic
evil” is highly specific. What is intrinsically evil is “the use of
contraceptives which has an effect of separating the unitive and
procreative meaning of sex”. But the procreative and unitive meanings
of sex are not present or are irrelevant in sexual intercourse outside
marriage. Rape, for instance has no unitive and procreative meaning;
hence, the use of contraceptives in rape cases does not fall on that act
which the Church considers to be intrinsically evil. Point 3 is
debatable. Pope Benedict said that use of condoms in order to prevent
HIV infection among prostitutes is a responsible act. The CDF
clarification had confirmed the Pope’s words.
HERE IS MY DETAILED COMMENTS:

MY REPLY:
CCC
2356 says “Rape is the forcible violation of the sexual intimacy of
another person. It does injury to justice and charity. Rape deeply
wounds the respect, freedom and physical and moral integrity to which
every person has a right. It causes grave damage that can mark the
victim for life. IT IS ALWAYS AN INTRINSICALLY EVIL ACT.” Rape violates
both the unitive and procreative purpose in the use of the sexual
faculties. It violates the unitive purpose since in this case the free
consent of another person is being violated and sex is engaged for the
purpose of selfish motives and not in total self-giving and irrevocable
commitment which can be guaranteed only within marriage. It violates the
procreative meaning since God willed that a new life should be brought
into this world as a fruit of the loving embrace between man and wife.
Intrinsically evil acts are acts which are evil [i.e., contrary to the
moral law] in themselves, regardless of the intention or circumstances
although the surrounding circumstances may lessen or increase the
gravity of the offense. These are acts which may not be directly willed
either as an end or as a means [such as direct abortion, killing of an
innocent person, rape, use of contraception] and the circumstances or
the intention will not change the nature of such acts. Thus even in rape
cases, the use of contraception, either as a means or as an end may not
be directly willed.
RDR says:
“Point

MY REPLY:
RDR
is correct in saying that indeed the Congregation for the Doctrine of
the Faith has already issued a clarification of the controversial words
of the Pope. The document is titled: “On the Trivialization of
Sexuality: Regarding Certain Interpretations of ‘Light of the World.’”
Pope Benedict XVI is a very learned theologian and in his writings there
are many parts which are difficult to understand “that the unwise and
the unlearned twist to their destruction” (2 Peter 3:16) to use the
words of St Peter in regard the writings of St Paul. This is precisely
what happened in regard the Pope’s statement as CDF put forward in the
opening paragraph: “The thought of the Pope has been repeatedly
manipulated for ends and interests which are entirely foreign to the
meaning of his words.” If we proceed to the alleged permissibility
of the use of condom in the prevention of the spread of HIV, CDF has
this to say: “In this situation, THE HOLY FATHER CLEARLY AFFIRMS THAT
THE PROVISION OF CONDOMS DOES NOT CONSTITUTE ‘THE REAL OR MORAL
SOLUTION’ TO THE PROBLEM OF AIDS.” Finally, on the words in questions CDF explains: “In
this context, however, it cannot be denied that anyone who uses a
condom in order to diminish the risk posed to another person is
intending to reduce the evil connected with his or her immoral activity.
In this sense the Holy Father points out that the use of a condom “with
the intention of reducing the risk of infection, can be a first step in
a movement towards a different way, a more human way, of living
sexuality.” Thus, what the Holy Father wanted to point out is that
those people who though engaging in promiscuous activities and regard
other people as objects of pleasure to satisfy their lusts, if they use
condom in order to reduce the risk posed to the other, in a sense they
still adhere to a certain good in them [that in respecting the life of
another] and this can be the starting point towards realizing the true
worth and dignity of the human person. In this situation, the person
performing the act is aware of the evil of his actions but only wanted
to lessen its gravity however this does not change the intrinsic evil in
the nature of such acts and therefore cannot be directly willed.

Manila Bulletin,
in what will probably go down as one of the lowest and most shameful
points in its history, declared that only 2,500 attended the rally.
According to the Philippine Daily Inquirer, there were only 7,000 at the rally today...
As for the Philippine Star, it counted "more than 10,000" at the rally.

Prayer to protect Life of the Unborn
"Our Loving Father and Creator, grant your help and protection for each child in the womb of expectant mothers. May they receive from their mothers proper nourishment, love and acceptance as you will every child to be welcomed in this world. By the power of your Holy Spirit, enlighten mothers who are planning to have abortion. Many of them are just being pressured into doing it by people around them. Your Son Jesus Christ, O Lord, reminded us whatever we do to the least of our brothers and sisters, we do it unto you. Please help these confused mothers find support and care especially from their own families and relatives. Send them concerned friends and individuals who will counsel and dissuade them against committing a grave sin. We pray for the conversion of abortionists that they may stop killing the helpless unborn and turn to you for forgiveness. Inspire us always to defend life from its very beginning when it is conceived in the mother's womb until the time when you take it back to yourself. AMEN."

The
Reproductive Health Bill is Unconstitutional
The Reproductive Health Bill (House Bill No. 4244) in its entirety is
unconstitutional because its very premise is at war with the philosophy
embodying the 1987 Constitution, dubbed as the Pro-Life Constitution.
The RH Bill proponents hail it as a solution to poverty in our country. They insist that
the RH Bill will spare children, especially those who are unwanted, from a life
of poverty. The RH Bill will save mothers from emotional trauma brought about
by child bearing. These arguments are not new. They were already discussed and
voted on the floor of the 1986 Constitutional Commission. The result is the
present Article II, Section 12 of the 1987 Philippine Constitution:
“Section 12. The
State recognizes the sanctity of family life and shall protect and strengthen
the family as a basic autonomous social institution. It shall equally
protect the life of the mother and the life of the unborn from conception.
The natural and primary right and duty of parents in the rearing of the youth
for civic efficiency and the development of moral character shall receive the
support of the Government.”
Constitutionalist Rev. Fr. Joaquin G.
Bernas, S.J., in his annotation on the 1987 Philippine Constitution, expresses
the sense of Article II, Section 12 that it “denies that the life of the unborn may be sacrificed merely
to save the mother from emotional suffering or to spare the child from a life
of poverty.”[1] The
commonsensical and constitutional solution to the problem was stated by Fr.
Bernas, thus: “The
emotional trauma of a mother as well as the welfare of the child after birth
can be attended through other means such as availing of the resources of
welfare agencies.”[2]

Constitution of the Republic of the Philippines: A Commentary" by
constitutionalist and member of the 1986 Constitutional Commission Rev.
Fr. Joaquin G. Bernas, S.J.
What does Article II, Section 12 seek
to achieve? Fr. Bernas answers that the provision was intended “primarily to prevent the state from adopting
the doctrine in the United States Supreme Court decision of Roe v. Wade which
liberalized abortion at the discretion of the mother any time during the first
six months when it can be done without danger to the mother.”[3]
Clearly, the
provision constitutionally outlaws abortion. There’s no chance that abortion
can ever be legal in this country as long as the 1987 Philippine Constitution
stands.
Abortifacients kill human life!
But what about the RH Bill? Does it
promote or facilitate abortion? The answer is a categorical Yes. While the RH
Bill purports to recognize abortion as illegal and punishable by law [Sec. 3
(9)], it however mandates “[a]ll accredited health facilities [to] provide a full
range of modern family planning methods” [Sec. 7]. Thus, the RH Bill is inconsistent
as best, duplicitous and hypocritical at worst.

While the RH Bill recognizes abortion
as illegal, it nevertheless allows the use of the “full range of modern family planning methods.” The RH Bill does not specify or list what these methods are;
hence, they could include the IUD (intra-uterine
device), the morning-after pills,[4]
and even manual vacuum aspirators[5]
– all of which are known abortifacients!
Copper IUDs prevent fertilized eggs from implanting in the
uterus.[6]
Hormonal IUDs slow down the growth of the uterine lining thereby making it
inhospitable for fertilized eggs.[7]
Prayer Power Rally Against the RH Bill on August 4, 2012 (1:00-7:00 P.M.)
Morning-after pills, otherwise known as Plan B pills, is
described as “the
backup plan for times when your birth control method has failed, has been
forgotten, or you weren’t on any form of birth control, and you don’t want to
get pregnant. Whether you’ve missed a few pills, the condom broke or slipped
off, or you forgot to insert your diaphragm.”[8] The Plan B pill can be taken up to 72 hours after “unprotected sex.” But what happens
within 72 hours? Is it possible that the sperm has already fertilized the egg?
Yes. And what does Plan B do in that eventuality? “If the egg is already fertilized, it
prevents the egg from attaching to the uterus” (implantation).[9]
Contraceptives promoted by the RH Bill
Manual vacuum aspirators cannot hide
its pretense as a mere contraceptive. It is in fact an instrument of death – an
early abortion machine.[10]
Is this among the “full range of modern family planning methods” (Sec. 7) or
the “full range of methods, facilities, services and supplies” (Sec. 4) sanctioned
in the RH Bill? The Bill is deceptively and fearfully silent.
Plan B Pills prevents the fertilized egg from attaching to the uterus thus killing it
The above examples of contraceptives
within the RH Bill package prevent the implantation of the fertilized ovum in
the uterus. Where does the Constitution come in in this regard? The
1987 Philippine Constitution categorically, unmistakably and
unequivocably
commands the State to protect the unborn “from conception.” Fr. Joaquin
Bernas
comments that “[t]he
unborn’s entitlement to protection begins “from conception,” that is, from the
moment of conception.”[11] What is the Constitutional intent? Fr. Bernas
expresses it: “The
intention is to protect life from its beginning, and the assumption is that
human life begins at conception and that conception takes place at
fertilization.”[12] It is crystal
clear that the constitutional definition of conception is fertilization, not
implantation. Human life begins at fertilization;
thus the fertilized ovum has human life and the State has the
constitutional obligation to protect that life.

Fr. Bernas concludes that Article II,
Section 13 of the 1987 Philippine Constitution “reflects the view that, in dealing with the
protection of life, it is necessary to take the safer approach.”[13]
The RH Bill militates against this constitutional mandate.
On August 7, 2012, when the members
of the House of Representatives make a crucial decision on the RH Bill, they
must be reminded of their oath “to uphold and defend
the Constitution.” To
vote in favor of this unconstitutional bill is a betrayal of their sacred oath
and of the trust of the sovereign Filipino people.
The 1987 Philippine Constitution is a
legacy of EDSA and CORY. We will go back to EDSA to remind the President
to honor that legacy. It is the legacy of his mother that we want to
preserve.

Six co-authors of the controversial reproductive health (RH) bill have expressed the intention to withdraw their support for the measure’s passage, the leader of the House opposition said Monday.
House Minority Leader Danilo Suarez said he and five other opposition lawmakers no longer wish to be co-authors of the RH bill a week before the lower chamber is set to put the measure to a crucial vote.
“Nagsabi sila sa meeting kaninang umaga na they are withdrawing support… We will just not vote, abstain during the voting,” he said in a phone interview.
Suarez declined to comment on whether the Catholic Church’s opposition to the RH bill affected some of his colleagues' stand on the measure.
The five other opposition House members who chose to withdraw their support for the RH bill were:
- Camarines Norte Rep. Elmer Panotes,
- Lanao del Sur Rep. Mohammad Hussein Pangandaman,
- AA-KASOSYO party-list Rep. Nasser Pangandaman,
- ALE party-list Rep. Catalina Bagasina, and
- Siquijor Rep. Orlando Fua.
None of the lawmakers was immediately available to explain their decision to withdraw support for the bill.
‘Thorough discussion’
The RH bill, formally known as House Bill 4244, has been undergoing debates at the House for more than a year now.
The measure, which as been identified by President Benigno Aquino III as a priority legislation, endorses the use of both natural and artificial modes of family planning.
The bill is being opposed by the Roman Catholic Church, which promotes only natural family planning methods.
Last week, the House leadership decided to put it to a vote on August 7 whether to continue plenary debates on the measure or not.
Suarez said that members of the minority believe that interpellations on the RH bill should continue.
“We think we should have a thorough discussion. Hindi naman ito bagay na puwedeng agad-agad ipasa. This is an issue of human rights,” he said. - BM, GMA News

Every birth is a gift from God; every new life, a
blessing; every birth a cause for rejoicing and praising God who creates
new life only out of love.
Our country’s positive birth rate and a population
composed of mostly young people are the main players that fuel the
economy. A fact that even the government itself acknowledges as it is
determined to feed, educate and keep the young people healthy.
And rightly so, for even our Constitution acknowledges that human resource is a primary social and economic force.
Earlier this year, the Bangko Sentral ng Pilipinas
reported that the hard earned salaries of overseas Filipino workers
(OFWs) that were sent to their families for the first 11 months last
year amounted to $18.3 billion, which is a 7.3 percent increase in the
same period in 2010.
Filipino men and women who endure the travails of working on foreign soil play a significant role in propping up our economy.
The country’s robust population is a big boost to
our economy, according to former US President Bill Clinton, local and
international financial institutions and the public sector.
It is therefore quite disturbing when the country
is told that having too many school children is a burden to the national
budget.
Can we have enough of schooled, skilled, diligent and highly driven young people who are a driving force of economic progress?
The draconian population control policy of the
Reproductive Health (RH) Bill would only curtail our economic growth.
The problem of countries with former robust economies is the lack of
young workers for their industries and inadequate support for their
aging population.
The issue on maternal deaths is a serious concern. The solution does not lie in suppressing births as provided in the RH Bill.
Providing proper and adequate maternal care could
be done without passing the RH bill, but by strengthening and improving
access to existing medical services.
There is an ill portent for the nation when government does not look at its own population as a source of grace and blessing.
There is a grave reason to worry when government
would rather suppress population through an RH bill instead of
confronting the real causes of poverty.

and reigns with you and the Holy Spirit, God, forever and ever. Amen.
